Ratio of private and public interests in regulation of relations on acquisition of the rights to land plots

Summary/Abstract: The article deals with the question of the relationship between private and public interests in the relations of land rights acquisition. The study of this question is based on the theory of the provisions contained in the works of G.F. Shershenevich with the existing Russian legislation and trends in development at this stage. The questions of the relationship between private and public interests in relations arise in determination of the legal regime of the land as an object of civil rights, in determination of the grounds and procedure of land rights, as well as in the relationship mediating strengthening land rights. The criterion of the balance of interests ratio is seen as a manifestation of the principle of participants’ equality in the civil relations.
