LEGISLATIVE DEVELOPMENTS AND PRACTICAL ASPECTS RELATING TO THE OFFENSE OF "DRIVING A VEHICLE ON PUBLIC ROADS BY A PERSON UNDER THE INFLUENCE OF PSYCHOACTIVE SUBSTANCES", PROVIDED FOR BY ARTICLE 336, PARAGRAPH 2 OF THE CRIMINAL CODE

Summary/Abstract: This article analyzes the legislative development of one of the offenses related to traffic safety on public roads, the one provided for in Art. 336 para. 2 of the Criminal Code, which, in the context of the growing trend of psychoactive substance abuse at national level, has naturally been increasingly present in the practice of the judiciary, generating different interpretations of the text of the incriminating norm and which has been regularly subject to constitutionality examination or to requests to the Supreme Court for the delivery of judgments deciding on the interpretation of the legal provisions in a binding and uniform manner.
