Personal Freedom and Political Rights. The Status and the Limits of Legitimacy

Summary/Abstract: The author takes the issue of personal liberty in the context of human rights within the political order which is the state. These issues are considered in the historical and theoretical context. He indicates its sources in the Roman law as well as their formation in modern political thought. In the theoretical order he analyzes the relationship between personal freedom and civil liberties as the institutions of law, as well as their relationship in political use. The author concludes his reflections with an attempt to determine the legitimacy of the analyzed law institutions and resulting from the proposed solutions within them, the consequences for humans as individuals.
