Summary/Abstract: The article is aimed at presenting an analysis of the punishment system of crimes in Romania and China. The authors have conducted a wide research based on the punishment and law systems in China with a comparison with the Romanian juridical system. A new juridical key value unit (JKVU) is introduced, regarding the different aspects between juridical notion of “incrimination” and “incarceration.” The article represents an interdisciplinary research in applied law and language with the aim of giving the lawmakers the necessary background for the future improvements of laws and the punishments within a common European Criminal Code.
