THE ECONOMIC CRIME IN CONTEMPORARY CONDITIONS

Summary/Abstract: The rules for the behavior of the members of the social community are a necessary prerequisite for its functioning in the direction of its productivity. Moral and customary norms lay the foundations of the behavior of the individual which is considered generally accepted and normal, but also of that behavior which hurts them. The most serious injuries have the character of criminal behavior and result in a punitive reaction by the state, which actually results from the protective function of the criminal law, which has the task of protecting the basic rights and freedoms of man and the citizen, but also the social order as a whole. Economic crime is a phenomenon represented in almost all countries of the world. Although it is a crime that is gaining momentum in modern conditions, what must be noted is that there is no unified definition of what exactly constitutes economic crime, which most likely results from the specific object of protection as a complex system of circumstances arising from the current socio-economic arrangement, which in these areas has recently transformed from a contractual to a market economy. The data show that the different definitions from the first attempts until today change depending on the social-economic order. Thus, if in the past the object of protection of economic (economic) crime was social property, today the object of protection in conditions of constitutionally guaranteed freedom of the market and entrepreneurship is not social property, but all types of property. Although the behaviors that were considered economic (economic) crimes have changed throughout social development, it seems that certain actions such as manipulation of various goods (especially basic food products), violation of competition, forgery of money, etc. existed long before the first attempts to define economic crime. What must be noted is that attempts at definition usually start from the criminal legal determination of this crime, so limited by the formal criterion are not sufficient for a comprehensive determination of the concept of economic crime
