Summary/Abstract: The changes made in the Criminal Code, as well as in other normative acts, because of the need to harmonize national legislation with that at the European level, by transposing into our legislation the various directives adopted at the level of the European Union, have generated non-unitary interpretations of the respective norms, in the specialized literature, an aspect that also affects the solutions in judicial practice. Moreover, there are different opinions regarding the applicability, at present, of the solutions pronounced by the High Court of Cassation and Justice, in appeals in the interest of the law, before the entry into force of the current Criminal Code.The changes made in the Criminal Code, as well as in other normative acts, as a result of the need to harmonize national legislation with that at the European level, by transposing into our legislation the various directives adopted at the level of the European Union, have generated non-unitary interpretations of the respective norms, in the specialized literature, an aspect that also affects the solutions in judicial practice.
