Practical issues regarding employee patrimonial liability. Case law synthesis and notes

Summary/Abstract: The patrimonial liability of the employee is one of the institutions of Romanian labor law with a particular practical importance, considering in particular the fact that it intervenes for acts committed with any form of guilt, including slight culpa. For this reason, the national jurisprudence illustrates numerous legal problems raised in litigations having this object. The article presents a synthesis of recent jurisprudence, with reference also to the older but relevant judicial practice, in which current problems regarding the patrimonial liability of the employee are addressed, highlighting also problems of non-unitary judicial practice in relation to aspects that do not find an approach in doctrine. Where appropriate, the author’s notes attempt to identify benchmarks for addressing these difficult labor law issues.
