Summary/Abstract: The article is an attempt to analyze a significant constitutional problem regardingthe possibility of subjecting the President of the Republic of Poland’s official actsconcerning the appointment of judges to administrative court control. The indicatedproblem arose in practice in 2008, during the presidency of L. Kaczyński, and thenin 2016, during the term of office of President A. Duda, and generally boils downto administrative courts refusing to review the President’s decisions declining to ap-point a given person to the office of judge. However, the study cites theoreticaland normative arguments that make it possible to challenge that practice.
