Summary/Abstract: The term Hijab has been customarily used to talk about the veil of the Muslim women as a duty imposed by their religious beliefs. The result of these inconsistencies is that we will focus on the original meaning of the rules of the classic Islamic Law namely, the idea that wearing the full veil and headscarf in the public sphere is a religious duty for Muslim women who live in democratic societies. The study of this issue is necessary in order to analyze the proportionality of the recommendations that have been established by the Council of Europe and legal restrictions on the right to wear such religious dresses that have been introduced the European Court of Human Rights.
