Summary/Abstract: The author of the article presents issues of substantive criminal law related to the offences for which one can appear before the common courts. He discusses the extent to which criminal law is repressive in historical and contemporary contexts, and offers suggestions for how it should look in the future. We can determine the degree of repressiveness on the basis of two determinants, namely the extent of penalisation and its intensity. The author discusses the historical regulations of the Criminal Code of 1932, the Penal Code of 1969 of Communist Poland and the modern regulations of the Criminal Law of 1997.
